What is and what is not marriage? Recently the Supreme Court ruled that marriage should be available to all. However, ICE (Immigration Customs and Enforcement) did not get that memo. Kujtim Jusufi birthdate 8-28-1968 Alien number: 029-440-380 AKA Jimmy came to the United States at 17 years old fleeing violence in his home country of Macedonia in 1985. The following is his struggle to survive and define what marriage is.

In 1987, after being denied the right to an education from a Detroit Public School. He fell in with a rough crowed and was arrested at 19 years old they found a firearm in his car. He never went to prison and paid his dues, stuck to probation and completed his community service.

In 1995, Jimmy married a United States citizen and turned his life around. He became a new husband and father to children from a previous marriage all in one day. Despite his prior arrest Jimmy was given a work permit and temporary green card. Then a year into the marriage he lost his green card and was denied a renewal.

ICE claimed the marriage was a fraud because a home visit showed that his wife had some clothes with tags on them in the closet. Despite affidavits from his ex-wife, neighbors, and landlord stating the marriage was legitimate and the two lived together Jimmy and his family became a target for ICE.

Jimmy took several jobs to keep food on the table making his time at home very rare. Add stress of immigration telling you your marriage in not legitimate. Led to problems in his marriage that could not be repaired. Jimmy divorced his wife in 2002 after having two appearances in immigration court (1996, and 2001) and the battle not being over. Jimmy’s wife decided she needed to be with someone who could provide for her family, spend a significant amount of time at home and not have to appear in court multiple times proving that they loved one another. With a divorce rate at almost 50% in the United States it is safe to say one can fall in love and out of love without being accused of fraud.

Jimmy did not lose hope on love. He remarried by a church in 2005, in the middle of his immigration court battle (he had court in 2005, 2012 and 2015). To an undocumented woman. If Jimmy was using marriage to gain documents in the United States he would have sought out another American woman. In this second marriage Jimmy has two United States citizen children that are 6 and 9 years old. They attend Munger elementary school in Southwest Detroit, Michigan.

Recently, Jimmy has been told he, his wife and his United States children have to be deported to Macedonia on July 31, 2015. Jimmy is 46 years old, a cook at Columbos in Detroit, Michigan. He does not have family in Macedonia or enough money to have his family survive. The United States is his home. He has been paying taxes here and working to better the economy. From working so much Jimmy has hernia now. Disabling him to work as hard as he has in the past. Jimmy’s wife and children need him here with them. His kids should have rights as citizens to not be forced to choose between being orphans in their own country or being sent to a death sentence in a foreign country.
